Welcome to AnChic. The terms “AnChic,” “we,” “us,” and “our” refer to SummitPeak INC, a Colorado corporation doing business under the AnChic brand.
SummitPeak INC operates this online store and website, including all related information, content, features, tools, products, and services made available through the website in order to provide customers with a curated shopping experience collectively referred to as the “Services.”
Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services to you. However, products purchased through this store are sold directly by SummitPeak INC, not by Shopify.
These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when accessing or using the Services.
Please read these Terms of Service carefully. They contain important information concerning product purchases, account responsibilities, warranty disclaimers, limitations of liability, and other legal rights.
By accessing, browsing, interacting with, or purchasing through the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not access or use the Services.

SECTION 1 - ACCESS, ELIGIBILITY, AND ACCOUNTS
By using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence and legally capable of entering into a binding agreement.
Products sold through the Services are intended for adult purchasers unless a product page or product label expressly states otherwise. You may not purchase products for use by a minor in a manner that conflicts with the applicable product label, warnings, or instructions.
To access certain features or purchase products, you may be required to provide information including your name, email address, billing information, payment details, telephone number, and shipping address.

SECTION 2 - PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to describe and display our products accurately. However, colors, size, appearance, packaging, or other visual details may appear differently depending on your screen, device, settings, production updates, or packaging revisions.
Product packaging, labels, ingredients, specifications, and appearance may be updated from time to time. The product label accompanying the product controls if there is a material difference between general website content and the current product label.
Product availability is not guaranteed. We reserve the right to discontinue a product, limit the quantity available for purchase, or restrict sales to particular persons, households, geographic areas, or jurisdictions when reasonably necessary.
Unless otherwise expressly stated, product experiences and results are not guaranteed and may vary from person to person.
You are responsible for reading the product label, ingredient information, directions, warnings, allergen disclosures, and other information provided with the product before use.
SECTION 3 - DIETARY SUPPLEMENT AND HEALTH INFORMATION
Products and information available through the Services are intended for general wellness and informational purposes only.
Nothing on this website is intended to provide medical advice or to replace advice, diagnosis, or treatment from a qualified healthcare professional. Information presented through the Services should not be relied upon to make decisions concerning a medical condition or treatment.
Dietary supplement products sold through the Services are not intended to diagnose, treat, cure, or prevent any disease.
Statements concerning dietary supplements have not been evaluated by the U.S. Food and Drug Administration unless expressly stated otherwise.

No communication with AnChic through the website, email, social media, customer support, reviews, or other channels creates a physician-patient, clinician-patient, or other healthcare professional relationship.
SECTION 4 - ORDERS AND ORDER ACCEPTANCE
Submitting an order constitutes an offer to purchase the selected products.
We reserve the right to accept, reject, limit, or cancel an order for legitimate business reasons, including suspected fraud, unauthorized resale, payment problems, pricing or inventory errors, geographic restrictions, or suspected misuse of our policies.
An order is not accepted until payment has been successfully authorized and we confirm acceptance or begin processing the order.
If we reject, modify, or cancel an order, we will make reasonable efforts to notify you using the email address, telephone number, billing address, or other contact information provided with the order.
Please review your products, quantities, shipping address, and payment information carefully before submitting an order.
You may request cancellation within one hour after placing an order, provided that fulfillment has not already begun. A cancellation request is not final until confirmed by AnChic.
Once an order has entered fulfillment or has shipped, it can no longer be canceled and must be handled in accordance with our Return and Refund Policy after delivery.

You represent that products purchased through the Services are for personal or household use and not for unauthorized commercial resale or export.
SECTION 5 - PRICES, DISCOUNTS, TAXES, AND PAYMENT
Prices, discounts, promotions, gifts, and product availability may change without notice.
The price charged will be the price displayed at checkout when the order is submitted, subject to correction of an obvious pricing or technical error.
Unless otherwise expressly stated, displayed product prices do not include shipping charges, handling charges, taxes, duties, customs fees, or other charges that may apply.
Prices offered through AnChic.com may differ from prices offered by Amazon, TikTok Shop, retail partners, marketplaces, or other third parties.
Promotions may be subject to separate terms, eligibility requirements, purchase limits, start dates, and expiration dates. If promotion-specific terms conflict with these Terms of Service, the promotion-specific terms will control for that promotion.
Discount codes cannot be combined unless expressly permitted. Discounts have no cash value and cannot be applied retroactively to an order that has already been completed.
We reserve the right to cancel, limit, or correct a promotion affected by fraud, misuse, unauthorized duplication, technical error, or other circumstances that undermine the intended operation of the promotion.
You agree to provide current, accurate, and complete payment and account information.
You represent that you are authorized to use the payment method submitted and that the payment information is true, correct, and complete.
You authorize us and our payment service providers to charge the applicable purchase price, shipping charges, taxes, and other amounts disclosed at checkout to your selected payment method.
SECTION 6 - SUBSCRIPTIONS AND RECURRING PURCHASES
This section applies when you select a subscription or another recurring purchase option.
By purchasing a subscription, you authorize us and our payment service providers to charge your selected payment method automatically at the price and frequency disclosed before checkout, until the subscription is canceled or otherwise terminated.
The subscription price, discount, billing frequency, shipment frequency, minimum commitment if any, and cancellation terms will be disclosed before you complete the subscription purchase.
Subscription prices and benefits may change. When required by applicable law, we will provide notice of a material change before it takes effect.
You may manage or cancel an active subscription using the customer account or subscription management method made available through the store, or by contacting support@anchic.com.
Subscription changes or cancellation requests must be completed before the next subscription order is processed. Canceling a subscription does not automatically cancel an order that has already entered processing or fulfillment.
An individual order generated under a subscription is subject to the cancellation, shipping, return, and refund terms applicable at the time that order is processed.
Canceling one order does not automatically cancel an active subscription unless the subscription itself is separately canceled.
We may suspend or cancel a subscription if payment cannot be processed, a product becomes unavailable, fraudulent activity is suspected, or continued fulfillment is not reasonably possible.
SECTION 7 - SHIPPING AND DELIVERY

Processing and delivery times displayed through the Services are estimates and may be affected by carrier operations, weather, holidays, address problems, inventory issues, or events outside our reasonable control.
Orders may be fulfilled by third-party logistics providers located within the United States.
If we become aware of a material delay affecting your order, we will make reasonable efforts to notify you using the contact information provided with the order and offer any options required under applicable law.
You are responsible for providing a complete and accurate delivery address. We cannot guarantee that an address can be changed after fulfillment begins.
If an order arrives damaged, contains an incorrect product, is missing an item, or is confirmed lost in transit, contact support@anchic.com with your order number and available supporting information.
Depending on the circumstances, we may provide a replacement, partial refund, full refund, or another appropriate resolution in accordance with our applicable policies.
Nothing in this section limits rights available to you under applicable consumer protection laws.
SECTION 8 - RETURNS, REFUNDS, AND SATISFACTION REQUESTS
Returns, refunds, and satisfaction requests are governed by our Return and Refund Policy:

Eligibility may depend on the purchase channel, request date, product condition, order type, prior use of the Satisfaction Guarantee, and other conditions explained in that policy.
Original shipping, handling, expedited shipping, and package protection charges are not refundable except where required by law or where the issue was caused by an incorrect, damaged, defective, incomplete, or confirmed lost order.
Submitting a return or refund request does not automatically approve the request. We may request reasonable order information, product photographs, lot or batch information, and experience feedback to confirm eligibility and determine the appropriate resolution.
Refunds that are approved will be returned to the original payment method unless otherwise required by law.
Nothing in these Terms removes or reduces an express right provided in our Return and Refund Policy or any non-waivable right available under applicable consumer protection law.
SECTION 9 - INTELLECTUAL PROPERTY
The Services and their content, including website text, product descriptions, graphics, photographs, videos, audio, product reviews, page layouts, designs, software, and other materials, are owned by or licensed to SummitPeak INC, LANOREL LIMITED, their affiliates, licensors, or other respective rights holders.
The ANCHIC name and related registered trademark rights are owned by LANOREL LIMITED and are used by SummitPeak INC under authorization. Other trademarks displayed through the Services belong to their respective owners.
These Terms permit you to access and use the Services solely for lawful, personal, and noncommercial purposes.
Without prior written authorization from the applicable rights holder, you may not reproduce, copy, modify, distribute, sell, resell, republish, publicly display, publicly perform, create derivative works from, download, store, scrape, or transmit website content except as permitted by applicable law.
Nothing in these Terms grants you a license or ownership interest in any trademark, copyright, patent, design, trade secret, or other intellectual property except for the limited right to access and use the Services in accordance with these Terms.
All rights not expressly granted are reserved.
SECTION 10 - OPTIONAL AND THIRD-PARTY TOOLS
The Services may provide access to tools, applications, payment services, review systems, subscription systems, return portals, or other services operated by third parties.
We may not monitor or control all aspects of these third-party tools.
Access to third-party tools is provided on an “as available” basis. Your use of a third-party tool may also be governed by that provider’s terms and privacy policy.
Before using a third-party service, you should review and understand the terms and policies provided by the applicable third party.
To the extent permitted by law, we are not responsible for losses caused solely by your independent use of a third-party tool outside our reasonable control.
We may introduce new tools, resources, and features in the future. Unless otherwise stated, those additions will form part of the Services and will be subject to these Terms.
SECTION 11 - THIRD-PARTY LINKS
The Services may contain links to websites, resources, or content provided by third parties.
We do not control and are not responsible for the accuracy, availability, security, or practices of third-party websites.
The inclusion of a third-party link does not necessarily constitute an endorsement.
If you choose to access a third-party website or purchase products or services from a third party, you do so subject to the terms and policies of that third party.
Questions or complaints concerning a third party’s products, services, or website should be directed to that third party.
SECTION 12 - RELATIONSHIP WITH SHOPIFY
AnChic is powered by Shopify, which enables us to provide the Services to you.
However, purchases made through our store are transactions directly between you and SummitPeak INC.
Shopify is not the seller of AnChic products and is not responsible for the formulation, manufacture, labeling, sale, shipping, delivery, return, refund, use, or performance of products purchased from AnChic.
To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising solely from a purchase or transaction between you and SummitPeak INC.
SECTION 13 - PRIVACY

Because the Services are hosted by Shopify, Shopify may collect and process certain information relating to your access to and use of the Services in order to provide, secure, and improve its platform and related services.

SECTION 14 - REVIEWS, FEEDBACK, AND USER CONTENT
If you submit a product review, photograph, video, testimonial, suggestion, idea, comment, proposal, or other content, collectively referred to as “Feedback,” you grant us a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, distribute, translate, and display that Feedback for purposes including operating, improving, and promoting the Services and our products.
This license does not transfer ownership of your Feedback to us.

We will not materially alter a customer review in a way that misrepresents the reviewer’s opinion or experience.
SECTION 15 - ERRORS, INACCURACIES, AND OMISSIONS
The Services may occasionally contain typographical errors, inaccurate information, technical errors, or omissions relating to product descriptions, pricing, promotions, shipping charges, availability, delivery estimates, or other matters.
We reserve the right to correct an error, update information, or cancel an affected order when reasonably necessary.
If we cancel an order because of our error after payment has been collected, we will issue an appropriate refund to the original payment method.
Nothing in this section permits us to avoid obligations that cannot be excluded under applicable law.
SECTION 16 - PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services:

We may suspend or terminate your account or access to some or all of the Services if you materially violate these Terms, engage in suspected fraud, threaten the security of the Services, misuse our policies, or create a material risk of harm to another person or to our business.
Where reasonably possible, we will limit the suspension or termination to what is necessary under the circumstances.
Termination does not affect payment obligations, rights, remedies, or provisions that arose before termination.
The provisions concerning intellectual property, privacy, user content, disclaimers, limitations of liability, indemnification, governing law, and other provisions that by their nature should survive will remain effective after termination.
SECTION 19 - DISCLAIMER OF WARRANTIES
Information presented through the Services is provided for general informational purposes. We make reasonable efforts to maintain accurate information but do not guarantee that all website content will always be complete, current, or error-free.

To the fullest extent permitted by applicable law, SummitPeak INC and its affiliates, directors, officers, employees, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of or inability to use the Services.
This limitation includes, where legally permitted, lost profits, lost revenue, lost savings, lost data, and replacement costs.
Nothing in these Terms limits or excludes liability for fraud, willful misconduct, gross negligence, personal injury to the extent caused by a violation of applicable law, or any liability that cannot legally be limited or excluded.
Nothing in this section removes any remedy expressly provided under our Return and Refund Policy or any mandatory consumer protection right.
Because some states and jurisdictions do not allow certain limitations of liability, some limitations above may not apply to you.
SECTION 21 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless SummitPeak INC and its affiliates, directors, officers, employees, contractors, licensors, and service providers from third-party claims, damages, liabilities, and reasonable legal expenses arising from:

The unenforceable portion will be treated as separated from these Terms without affecting the validity and enforceability of the remaining provisions.
SECTION 23 - WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce a right under these Terms does not waive that right.
These Terms, together with the policies and operating rules referenced in them, constitute the agreement between you and us concerning your use of the Services and supersede prior communications or proposals concerning the same subject matter.
If another published policy specifically governs a matter, such as shipping, subscriptions, privacy, returns, or refunds, that more specific policy will control for that matter to the extent of a direct conflict.
SECTION 24 - ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer these Terms as part of a merger, reorganization, sale of assets, corporate restructuring, or transfer of the business, subject to applicable law.
Any assignment does not reduce rights that cannot lawfully be waived.
SECTION 25 - GOVERNING LAW AND JURISDICTION
These Terms and any separate agreements through which we provide the Services are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
Any dispute that is not resolved informally may be brought in a court of competent jurisdiction in the State of Colorado, including an applicable state court in El Paso County or the United States District Court for the District of Colorado.
Nothing in this section deprives a consumer of any mandatory protection or right to bring a claim in another forum when that protection or forum right cannot lawfully be waived.

When required by applicable law, we will provide notice of a material change and state when the updated Terms become effective.
Your continued use of the Services after updated Terms become effective constitutes acceptance of those changes to the extent permitted by applicable law.
The effective date displayed at the beginning of these Terms indicates when the current version became effective.
